Terms of Service

These Terms of Service ("Terms") govern your access to and use of Never Ending Hero RPG (the "Game") and any related websites, applications, and services (together, the "Service") provided by Missroot ("we", "us", "our"). By installing, launching, or playing the Game you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

You also represent that you are not located in, or a national or resident of, any country to which the export of the Service is prohibited by applicable law.

2. Your account

Cloud saves and cross-device progress require an account. You are responsible for safeguarding your sign-in credentials and for any activity under your account. We recommend a strong, unique password. Notify us immediately at support@missroot.com if you believe your account has been compromised.

You may sign in using email/password or supported third-party providers (such as Google or Apple Sign-In). Authentication is provided through our service provider and is subject to that provider's terms.

You may close your account at any time using the in-game Settings → Delete Account option, or by visiting our account-deletion page.

3. License to play

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Game on devices you own or control, solely for your personal, non-commercial entertainment.

This license does not allow you to:

• copy, modify, reverse engineer, decompile, or disassemble the Game except as permitted by applicable law;
• create derivative works based on the Game;
• rent, lease, sublicense, sell, or otherwise transfer the Game;
• use the Game in any commercial, broadcast, or public performance setting without our written permission;
• use bots, scripts, automation, modifications, exploits, or third-party software to gain an unfair advantage or interfere with the Service.

4. Virtual items, Gems, and purchases

The Game includes Gems and other virtual items, virtual currencies, and digital content (collectively, "Virtual Items"). You may acquire Virtual Items by playing the Game or by purchasing them through a supported app store (such as the Apple App Store, Google Play Store, or Steam) using real-world money.

Virtual Items are licensed, not sold. You acknowledge that:

• you do not own Virtual Items — you receive a limited, personal, revocable, non-transferable license to use them within the Game;
• Virtual Items have no monetary value and cannot be redeemed for cash or any real-world value;
• Virtual Items are non-transferable between accounts and are not exchangeable outside the Service;
• balances and items are tied to your account and may be lost if your account is closed, suspended, or terminated, or if the Service is discontinued;
• we may modify, recall, balance, or remove Virtual Items at any time as part of normal game operations.

All purchases of Virtual Items are processed by the relevant app store and are governed by that store's terms (for example, the Apple Media Services Terms, Google Play Terms of Service, or the Steam Subscriber Agreement).

5. Subscriptions

The Game offers optional auto-renewing subscriptions ("Explorer", "Vanguard", "Paragon", "Ascendant"). Each subscription grants in-game benefits such as faster game speed, gold and EXP boosts, and a daily Gem stipend, for the period stated at purchase.

• Payment is charged to your store account at confirmation of purchase.
• Subscriptions automatically renew at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your store account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions in your store account settings (Apple ID / Google Play Account / Steam) — not within the Game.
• Cancelling a subscription stops future renewals; you keep the benefits through the end of the current paid period.

6. Refunds and store policies

All purchases are final and non-refundable except where required by applicable law or the policies of the store through which you purchased. Refund requests must be made directly to the relevant store:

• Apple — Request a refund
• Google Play — Refund policy
• Steam — Refunds

We may, in our sole discretion, offer in-game compensation in exceptional circumstances (for example, a confirmed Service outage), but this does not constitute a refund of real-world money.

7. User conduct

You agree not to use the Service to:

• violate any law, regulation, or third-party right;
• harass, threaten, defame, or impersonate any person;
• upload or transmit malicious code or interfere with the Service's operation;
• cheat, exploit bugs, or use unauthorized third-party software, bots, or modifications;
• attempt to gain unauthorized access to other accounts or to our systems;
• create accounts using false information or for the purpose of evading a prior suspension.

8. User content (nicknames and similar)

The Game lets you choose a public nickname. You are solely responsible for the content you submit. By submitting a nickname or other content, you grant Missroot a worldwide, royalty-free, sublicensable license to host, display, and distribute that content within the Service for the purpose of operating the Service.

Nicknames and other user content must not contain hate speech, sexual content involving minors, threats, real personal information, or anything else prohibited by applicable law or these Terms. We may remove or change any user content that violates these Terms at our sole discretion.

9. Intellectual property

The Game, including its art, music, code, text, characters, and trade dress, is owned by Missroot and its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 3, all rights are reserved.

10. Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without cause and with or without notice, including if you violate these Terms. Upon termination, the licenses granted to you end and you must stop using the Service. Sections that by their nature should survive termination (including Sections 4, 6, 9, 11, 12, 13, 15) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MISSROOT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MISSROOT OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $50.

13. Indemnification

You agree to defend, indemnify, and hold harmless Missroot and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right.

14. Changes to the Service or Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may update these Terms from time to time; the updated version will be posted at this URL with a new effective date. Material changes will, where practicable, be communicated through the Game or our website. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be brought in the Seoul Central District Court, unless otherwise required by mandatory consumer protection law in your country of residence.

16. Additional terms for the Apple App Store

If you obtained the Game through the Apple App Store, the following additional terms apply:

• These Terms are an agreement between you and Missroot only, not with Apple. Apple is not responsible for the Game or its content.
• The license granted in Section 3 is limited to use of the Game on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
• Apple has no obligation to provide maintenance or support for the Game.
• If the Game fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
• We, not Apple, are responsible for addressing any claims relating to the Game, including product liability claims, claims that the Game fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• We, not Apple, are responsible for any third-party intellectual property infringement claims relating to the Game.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
